MINUTES OF THE OCTOBER 27, 2000 MEETING

The twentieth regular meeting of the Hamburg Borough Council was held this evening at the Hamburg Municipal Center with President Richard Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

A motion was made by Scott Kreider and seconded by Charles Figard to approve the amended agenda.

COURTESY TO AUDIENCE

John Shultz, a resident of Grandview Terrance as well as Dolores Yoder, Arlan and Dorothy Greenawalt and Dennis Vogt were present to discuss the condition of Grandview Terrace. These residents feel that Grandview Terrace is in awful condition and should be repaved. Two residents stated that they have lived there for 54 years and that it has never been repaved. They would like this brought to the attention of Council and have something done about it. President Boyd turned it over to the Road Committee who will meet on November 8, 2000.

A motion was made by Roy Heffner and seconded by Diana Edwards to approve the minutes of October 9, 2000 meeting.

ENGINEER'S REPORT
SANITARY SEWER SYSTEM

SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal for this time of year. The operators are handling filamentous problems as required.

INDUSTRIAL INSPECTIONS

No issues this month.

MID-ATLANTIC CANNERS

No issues this month.

LOCAL LIMITS CALCULATIONS – No Change

SDE submitted calculations of new local limits to the EPA as required by the NPDES permit for the wastewater treatment plant. We are waiting for the EPA’s comments on this submission.

WINDSOR AUTHORITY

Sources and uses of funds for the Hamburg/Windsor merge have been reviewed and will be discussed at the meeting (see attached Exhibit A of the Guaranteed Sewer Revenue Bond, Series 2000).

WATER SYSTEM (COUNCIL: FOR INFORMATION ONLY)

WATER PRODUCTION

Unfortunately, the filtration plant is still out if service. A new controller has been ordered, and the streaming current monitor is being repaired. Well number 5 is functioning as this time. However, the system still requires fine-tuning.

On the recommendation of the Safety Committee, a motion was made by Leon Balthaser and seconded by Charles Figard granting a three month extension for a handicapped sign at 512 S. 5th Street.

A motion was made by Roy Heffner and Charles Figard to remove from the table the issue of appointing Joe Wertz to the Planning Commission.

(Discussion: It was stated that we are in need of 3 members for the Planning Commission and that if one of the current members doesn’t show up for a meeting there would be no quorum. It was asked if the position has been advertised and it was stated that the advertising has been done and there was no one who showed any interest and there was one individual who has contacted and that individual did not return the phone calls. )

The motion from the October 9, 2000 meeting was that Joe Wertz be appointed to the Planning Commission replacing Roy Heffner until the vacancy can be advertised.

This motion was made by Leon Balthaser and seconded by Scott Kreider.

NEW BUSINESS

On the recommendation of the Borough Manager, a motion was made by Roy Heffner and seconded by Diana Edwards to renew the trash and recycling contracts for 2001, with the contract increasing by mutual agreement at an amount equal to the annual cost of living as determined by U.S. Department of Commerce at the end of the contract term.

(Discussion: It was questioned what the new rate would be. Manager Albright stated that she was unsure at this time until the end of the year came around. Manager Albright stated that it was by mutual agreement of both parties and there has not been a problem in the past.)

The Mayor declared a 90 day trial period to perform the following: an extension of the red fire zones for the Union Fire Company as follows: 104 feet on the south/west side of the fire company from the existing red zone south to the yellow area at the corner; 100 feet on the south/east side from the yellow area at the driveway to back of foundry south to the handicapped crosswalk; and 22 feet north/west side from existing red zone north one property width.

(Discussion: The parking issue was discussed and the fact that maybe the Keystone who owns the empty lot across from the fire company would be willing to put in a drive over curb, allowing individuals/fire fighters to park there. Councilman Kreider will check into this. Instead of having an ordinance written and advertised, the decision was made to put this in effect for a 90 day trial period by Mayor Del Rosario.

On the recommendation of the safety committee, a motion was made by Leon Balthaser and seconded by Scott Kreider granting approval to the Greater Hamburg Business Association to hold the annual Christmas Parade on Saturday, December 2, 2000 starting at 9:30 a.m.

A motion was made by Scott Kreider and seconded by Charles Figard to approve payment of invoices totaling $75,918.66

(Questions: Councilman Figard questioned the bill for the jackets for the police department. Chief Zelinsky stated that one jacket was for a part-timer and the other was for a newly hired individual. Councilman Balthaser questioned the bill to Randy Kline – clean up of 33 Church Street. Manager Albright stated that this was for a property that was not cut and we have billed the property owner. Mr. Balthaser also requested a copy of the CTG bill. Councilman Kreider questioned the notepad with initials for the police department. Chief Zelinsky stated that it came out of their uniform allotment. Mr. Kreider questioned the Synergetics bill – is the Library turret still under the $1,000. Recording Secretary Kim Berger stated that it was under the $1,000 contract and they still had $135 balance. Mr. Kreider also questioned the AT & T bill for sewer – Kim stated that the Authority gets billed for that.)

Councilman Balthaser asked if the Borough or the Rotary Club was to purchase the signs for the two trees that were donated for the Municipal Building. No one seems to remember that the borough was going to purchase these signs, apparently the Rotary was going to take care of this.

SOLICITOR’S REPORT

Solicitor Speicher questioned the fire police resolution. Manager Albright stated that was adopted at the last council meeting.

Solicitor Speicher gave an update on the lawsuit involving Stirling Engineers and their supplier for the windows for the municipal building.

Solicitor Speicher stated that in regards to the agreement submitted by the Berks County Communications Center – he found nothing wrong with the agreement. Manager Albright and Chief Zelinsky will discuss this.

Solicitor Speicher stated that an executive session needed to be held in reference to: Auditor General, an employee in the office and a matter involving a police officer.

An executive session was held from 8:07 p.m. to 9:15 p.m.
