MINUTES FROM THE NOVEMBER 27, 2002 MEETING OF BOROUGH COUNCIL The twenty-second regular meeting of the Hamburg Borough Council for 2002 was held this evening at the Hamburg Municipal Center with President Rick Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer. Members Present –Rick Boyd, Roy Heffner, Leon Balthaser, Diana Edwards, Dale Schlenker, Charles Figard Members Absent – Jeanette Heckman Also Present – Lynda G. Albright, Borough Manager, Kim Y. Berger, Recording Secretary, Solicitor
Visitors- Mike Williams (Pottsville Republican), Val Lacis (Reading Eagle), Thomas Zelinsky, A motion was made by Diana Edwards and seconded by Roy Heffner to approve the amended agenda. Schlenker NAYES – None COURTESY TO AUDIENCE NONE A motion was made by Charles Figard and seconded by Dale Schlenker to approve the minutes of the November 11 and November 15, 2002 meeting. Schlenker NAYES – None A motion was made by Roy Heffner and seconded by Diana Edwards to approve the following reports: Engineer’s Report, Finance Committee, Personnel Committee and Safety Committee Report. (Councilman Figard stated that in the Safety Committee report, it should state that "not" all postal workers would get out of their trucks to deliver the mail. The word "not" was missing.) (Councilman Balthaser stated that since Sgt. Painter has received a certificate from the Fraternal Order of Police and since the Borough had given him two days suspension for this same incident, maybe it should be reconsidered. WATER SYSTEM WATER PRODUCTION The level of the impoundment dam remains between the upper and lower intake. The past rainfall has only increased the level of the dam by about 1 foot. All the production if from the Authority’s wells. WATER PROJECTS The blow off project is continuing. The separator has been ordered and the project will be completed when it arrives. The Impoundment Dam Inspection Report is being completed for the end of the year submittal. NPDES PERMIT RENEWAL-(no change) Systems Design Engineering, Inc. has submitted the additional test analyses requested by DEP. The permit is being reviewed. HAMBURG CENTER
FINANCE COMMITTEE NOVEMBER 11, 2002 Attending: Jeanette Heckman, Lynda Albright, Roy Heffner, Rick Boyd, Chuck Figard and Dale Schlenker The 2003 budget was discussed and it was determined that the Property Maintenance Fee will not be included in the budget until collection procedures are clear. A special meeting will be held on November 20, 2002 at 3 p.m. at the municipal building, to review the proposed budget for the 2003 year. Dale Schlenker, Finance Chairman PERSONNEL COMMITTEE Tuesday, November 12, 2002 Persons present: Councilpersons – Heckman, Figard, Schlenker, Boyd, and Borough Manager, Lynda Albright Business discussed: Requests from personnel as regards to pay, medical compensation benefits (Heart and Lung) for a particular matter in police department, and holding the line or modest pay raises at all levels for all borough employees. All matters were thoughtfully pondered. Members present felt it wise to proceed cautiously in regards to hiring, raises, and changes in medical coverages. Respectfully submitted Jeanette E. Heckman Safety Committee The committee met at 7:00 p.m. Tuesday, 19 Nov. Chief Zelinsky, Leon Balthaser and Charles Figard were present: The following items were discussed: Noise from Jack D’s "Back Door Bar and Grille" Update on curb painting request on S. 7th St Sample crossing guard ordinance Mr. Ceylon Koppenhaver voiced a complaint about noise from Jack D’s , especially during early morning hours. Chief Zelinsky explained the steps taken by Jack D’s to reduce the noise so that he is not causing problems for his neighbors. Chief explained that a citation had been given to Jack D’s and that complaints will be dealt with promptly. Chief Zelinsky will provide information to Mr. Leiby concerning any vehicle blocking his driveway. Regarding a blocked mailbox, the regular postman on S. 7th St. stated that if a vehicle blocks a mailbox, he gets out of his truck and delivers the mail. He also stated that all postal workers would do that. An inquiry at the post office provided information that mail should always be delivered, obstruction or not. Rural areas are where problems occur, not in the town. The committee sees no reason for any more painting of the curbs on S. 7th St. It is recommended that Council members read the sample ordinance (attached) related to school crossing guards with the possibility of Hamburg School District taking over the hiring and oversight of the guards. The SRO in the past has done that for the police department and could now perform the task for the District. Meeting ended at 8:00 p.m. Charles R. Figard OLD BUSINESS A motion was made by Charles Figard and seconded by Roy Heffner to adopt Ordinance #714-02, mandating the use of electronic media for employers earned income tax reporting requirements. Schlenker NAYES – None NEW BUSINESS On the recommendation of the Finance Committee, a motion was made by Charles Figard and seconded by Dale Schlenker to tentatively approve the 2003 Budget in the amount of $2,312,200.00. Schlenker NAYES – None On the recommendation of the Finance Committee, a motion was made by Roy Heffner and seconded by Dale Schlenker to authorize the Borough Manager to prepare and advertise the 2003 Tax Ordinance setting the tax rate at 3.0 for general operating and .5 mills for capital reserve). Schlenker NAYES – None On the recommendation of the Personnel Committee, a motion was made by Charles Figard and seconded by Diana Edwards to appoint Pat Adams as a member of the Hamburg Library Board to fill the vacancy created by the resignation of Barbara Samide. The uniform company is not holding up to the contract. The uniforms are tattered and are older than feasible. The Borough has sufficient evidence to prove our case. A motion was made by Charles Figard and seconded by Roy Heffner to authorize the solicitor to write a letter to National Uniforms terminating our contract effective 12/31/02. ROLL CALL: AYES – R.
