MINUTES FROM APRIL 25, 2001 MEETING OF BOROUGH COUNCIL

The eighth regular meeting of the Hamburg Borough Council for 2001 was held this evening at the Hamburg Municipal Center with Vice-President Roy Heffner presiding.  The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

 A motion was made by Jeanette Heckman and seconded by Charles Figard to approve the amended agenda.

A motion was made by Charles Figard and seconded by Diana Edwards to approve the minutes of April 9, 2001, April 12 and April 16, 2001.

Engineer’s Report

SANITARY SEWER SYSTEM 

  • SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal for this time of year.  Treatment is within normal parameters. 

  • MID-ATLANTIC CANNERS

Systems Design Engineering, Inc. and Keith worked with MACA this month on waste strength issues. 

  • LOCAL LIMITS CALCULATIONS

The EPA has accepted the local limits as submitted by SDE.  Lynda is working on obtaining proof of adoption of the new limits from all boroughs and townships. 

·        SLUDGE PUMP PROJECT

The mechanical and electrical contractors are progressing with the contract.  Most of the shop drawings have been submitted and approved. 

WATER SYSTEM (COUNCIL: FOR INFORMATION ONLY) 

·        WATER PRODUCTION   

The impoundment dam is currently full.  Water flow over the spillway has increased due to recent rainfall events.  The operators cleaned the debris from the basin at the inlet side of the reservoir. 

A ground fault indicator caused some minor disruptions at the plant with regard to the streaming current monitor.  At this time, the problems have been remedied.  Otherwise, the filter plant has been running normally.  Both radon strippers have been cleaned as part of normal, maintenance.  The blow-off and strainer for wells 2, 3, & 4 has been installed.  

·        HAMBURG CENTER 

Systems Design Engineering, Inc. will discuss the project with the Authority at the meeting.  Bruce Paskar form Hamburg Center is expected to be in attendance at the meeting. 

·        WINDSOR PUMP STATIONS 

Systems Design Engineering inspected both pump stations with Keith.  Recommendations for improvements are being prepared. 

·        FILTRATION PLANT LIGHTS 

The existing lights have been repaired and/or replaced.  Mounting heights of the lights will be discussed at the meeting.   

·        PROJECTS IN PROGRESS

Property Committee Report

 April 3, 2001

Guests:  Representatives from the Northern Berks Chamber, Windsor Ind., Breon Riegel Family

 Fred Sheeler of Northern Berks Chamber presented a brief description of some plans for the start to the Main Street program.  They intend to apply for state grants, along with local financial sources.  They are also exploring the possibility of federal assistance.  The intent is to revitalize the downtown areas of Hamburg.  Among the ideas are improving the downtown appearance and promoting the downtown businesses and their merchandise; emphasizing the personal service and value available in Hamburg shops.  Revitalization should draw investors, deter crime, attract employers, increase tax base and property values, help preserve our history and community pride.  The boundaries of the area covered by this program have not been designated.  They are about one year from applying for any grant money.  They request that Council consider budgeting future moneys to support this endeavor.

Breon Riegel requested permission to re-paint the band shell in the park.  This is part of his project to attain the Eagle award in scouting.  He will obtain all needed supplies and will have adult supervision during the project.  Unanimous consent and encouragement from the property committee to allow him to proceed.

Cub Scout Troop 120 has requested permission to plant about 50 trees along the towpath as a project for them.  They have also asked for recommendations as to the type of tree to be planted.  Property committee has given approval for them to proceed and suggested that the trees be a spring flowering tree, selected at their discretion.

Doug Mehrkam of Windsor Ind. Addressed the committee concerning issues of code violations at his property as a result of last year’s fire.  His concerns were the multiple building safety inspectors that reviewed his project and claims that each inspection fount additional code problems.  A representative from SDE was present to address the issues.  Mr. Mehrkam needs to complete the demolition and request an inspection.  There were no fines issued for the code violations.  The Committee apologized for the changing inspectors due to unforeseen circumstances.

The baby pool was examined.  It needs to be sand blasted and repainted due to the sharp edges that are there.

Some of the older equipment at the Tot Lot will be repainted.

Permission was given for the Jaycees to use the park for Memorial week with the same conditions as previous years.

Recreation Board requested permission to  1) build a concession stand at the ball field and   2) erect an electronic scoreboard.  This would be at no cost to the borough.  Property committee agreed.

Greater Hamburg Business Association will be offered the use of the Boro Hall it there is inclement weather for the Artist day; also, Boro manager was directed to look into sponsoring an artist by the Boro.

Building Permits – there was substantial discussion on the plans for new guidelines in issuing building permits for residential dwellings.  It was agreed to use the guidelines as suggested by the building safety inspector with a list of certain exemptions.  This would not carry a financial limit.  Along with this there would be a new fee structure for when a permit is required.  The proposal will be prepared and presented for the council meeting in the near future.

SAFETY COMMITTEE REPORT

 
The Hamburg Diner owner requested a parking limit of 2 hours on South side of State St at 2d St.  Also requested Cruise Nite for a specific evening along State Street.  If approved by Council PENNDOT must be advised and approve the request.  Mayor will be requesting to issue a 90 day proclamation for a test period of the parking request.

*  Request to limit parking at corner of State & 2d (along old Nelco Storage building) on the north & east side of State St. will be reviewed by Chief Zelinsky and a council member prior to deciding on the proper solution.

*  PENNDOT will be requested to post a traffic signal warning on State St. in vicinity of St. Mary’s Church.

*  A request was made to limit parking to 15 minutes vice 2 hours in front of Kurtz Flowers on State Street.  No committee action taken until further information is received.

*  The new style bullet-proof vest was shown.  Each cost $1000.00.  Borough police have seven of the vests, which must be worn by uniformed patrol duty officers.

*  Memorial Service will be conducted at Methodist Church on 20 May for John and Chief Lewars.  Time to be announced.

*  Chief Zelinsky presented a Job Analysis Manual for the Borough Police and a Use of Force Policy, describing actions to be taken in apprehending suspects.

*  Discussed installing plaques at sites of officer’s deaths in Hamburg. 

No action taken at this time.

*  New accident reports were discussed – the reports are considered too long & complicated & will be discussed again when the final form is determined.  Many police departments have complained about the new reports.

*  Telco will review maintenance of the lights at 61 & 4th St. to determine if lights need to be retimed for vehicles using turning lane of southbound Rt. 61, so that tractor trailers will not be stopped at the second light causing the trailer to block northbound traffic on Rt. 61.

*  Borough police aided in apprehending four persons who had been cashing fraudulent checks at local businesses.  Sgt. Painter was praised by Chief Zelinsky for his excellent police work in aiding apprehension of the culprits.

*  Police also recovered a stolen vehicle minutes after the report was
received.

*  On 13 May Officer John Ayello’s name will be placed on the Wall of Honor in Washington, D.C.  Persons desiring to observe this special honor may do so by calling Michelle Ayello (610-562-8199)  to reserve a bus seat.  (25.00 per person)

*  No action taken pending more information concerning a request to establish one hour parking on State St. between 3d & 4th streets during evening hours.

OLD BUSINESS

On the recommendation of the Property Committee, a motion was made by Jeanette Heckman and seconded by Charles Figard to reaffirm approval of the final land development plans for the Hamburg Area School District Project.

On the recommendation of the Safety Committee, a motion was made by Leon Balthaser and seconded by Charles Figard to approve an additional 90 day extension for a handicapped parking space for Edward Painter at 522 S. 5th Street, Hamburg, PA.

 NEW BUSINESS

On the recommendation of the Police Negotiating Committee and Safety Committee, a motion was made by Charles Figard and seconded by Diana Edwards to approve amending the current police contract to include creating the position of Field Training Officer and paying an additional $1200/yr. for this position.

On the recommendation of the Sewer Committee, a motion was made by Jeanette Heckman and seconded by Charles Figard to authorize the Borough Manager to prepare and advertise an ordinance dealing with local limits as required by law.

On behalf of the Mayor, Vice-President Heffner read the following proclamation to address the closing of streets and parking for the Arts and Crafts Festival. 

Under Section 4, Chapter XV, as amended by Ordinance #638 dated December 5, 1994, the following parking restrictions will be in effect on May 19, 2001 for the Annual Arts and Crafts Festival.

 PARKING IS PROHIBITED ON THE FOLLOWING STREETS BETWEEN THE HOURS OF 8 AM TO 3 PM 

            ON STATE STREET BETWEEN 3RD AND 4TH STREETS 

            ON S. 4TH STREET BETWEEN STATE ST. AND PINE STREET.

SOLICITOR’S REPORT

Solicitor Speicher presented and reviewed the resolution/agreement between the Borough of Hamburg and the Hamburg Area School District.  This agreement was made after the emergency meeting last week.

 A motion was made by Jeanette Heckman and seconded by Charles Figard to distribute the draft form of the agreement to the School District for their attorney to review it before it is finalized.

Borough Manager reported that the Borough received thank you letters from Breon Riegel for both Borough Council and Property Committee for approving his Eagle Project and suggestions made by the committee.

 There being no further business, the meeting adjourned at 7:52 p.m. on motion of Diana Edwards and seconded by Leon Balthaser.
