MINUTES FROM THE JANUARY 26, 2004 MEETING OF BOROUGH COUNCIL

The second regular meeting of the Hamburg Borough Council for 2004 was held this evening at the Hamburg Municipal Center with President Adam Dries presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

Members Present – Adam Dries, Tammy Wilkinson, Dale Schlenker, Charles Figard, Jeanette Heckman, Tina Yoder, Martha Bertolet

Members Absent – None

A motion was made by Dale Schlenker and seconded by Charles Figard to approve the amended agenda.

COURTESY TO AUDIENCE

Richard Boyd stated that the borough still has criminals walking around and the police department is unable or unwilling to apprehend.

Mr. Boyd also stated that in regards to the crossing guard policy, if this is to be an official document it should have official titles, so the Chief of Police for Michael Painter should state Acting Chief of Police.

Mr. Boyd stated that the policy misses a key management prospective. A very important issue is that it gives no assurances before there is an incident, namely, inspections or periodic checks of the crossing guards in a timely manner throughout the year. Mr. Boyd stated that the policy lacks the subject of personnel files being kept on the crossing guards. The policy does not state it anywhere.

A motion was made by Tina Yoder and seconded by Jeanette Heckman to approve the minutes of the January 5, 2004 meeting.

A motion was made by Tammy Wilkinson and seconded by Dale Schlenker to approve the following reports: Engineer’s Report, Treasurer’s Report, Safety Committee Report and Personnel Committee Report.

(Councilman Schlenker stated that in the Crossing Guard Policy the title for Painter should be changed to Acting Chief of Police).

ENGINEER'S REPORT
January 21, 2004

SANITARY SEWER SYSTEM

· SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal to high for this time of year. Treatment is within normal parameters.

Systems Design Engineering, Inc. continues to work on the capacity issue of the wastewater plant and pump stations. A meeting was held with Authority officials and the State to determine avenues of funding for the project. Systems Design Engineering, Inc. has just received tributary flow data from Cabela’s for their parcels. Additional flows from Tilden, Hamburg, Windsor and Port Clinton are being analyzed for total capacity. Estimated costs cannot be calculated until the final capacity is determined.

Flow equalization versus full treatment is being analyzed. Treatment options versus flow equalization are currently estimated to be more cost effective. A verbal report will be given.

· CORRECTIVE ACTION PLAN

The Corrective Action Plan and Connection Management Plan have been approved by the Department of Environmental Protection. A verbal report will be presented.

· MID-ATLANTIC CANNERS

Systems Design Engineering, Inc. continues to talk with MACA on future needs. The Authority has received a letter from MACA pursuant to organic load. MACA is considering an additional capacity purchase of 200 pounds of BOD to take their long term capacity from 700 to 900 pounds. Systems Design Engineering, Inc. is using this request in the capacity review.

SPECIFICATIONS

As reported at the last meeting, the Solicitor and Systems Design Engineering, Inc. met to bring the draft specifications to completion. The Solicitor submitted the Rules and Regulations for review at the meeting. Systems Design Engineering, Inc. has prepared the Pretreatment Regulations and Technical Drawings. The Pretreatment Regulations and Technical Drawings are the same as previously submitted with slight revisions in the form of typographical corrections and form. The Board should discuss any required changes and/or approve the documents.

Plant Expansion Study

WATER SYSTEM

WATER PRODUCTION

The impoundment dam remains full with recent rains greatly improving inflow. Most production this reporting period has been from the surface water filtration plant.

The programming for the Filter Plant has been nearly completed and the plant is again producing water. The report on the Filter Plant Performance Evaluation (FPPE) was received. The system received a satisfactory rating. Plant operators are to be commended on this review and rating. Systems Design Engineering, Inc. is working with the operators on some recommendations included in the FPPE.

Systems Design Engineering, Inc. continues to work with Plant Personnel on new and proposed regulations that may effect the System in the future.

WATER PROJECTS

Kohl Brothers worked last week at improving the level control of the high service pump. The variation of flows and pressures was improved and it will be watched closely in the upcoming month.

Systems Design Engineering, Inc. is assisting plant personnel with the Radon Study.

VULNERABILITY ASSESSMENT

Systems Design Engineering, Inc. is working on the Vulnerability Assessment for the water system and will report recommendations for review.

Safety Committee

The committee met at 3:30 Tuesday 20, January 2004 with Lynda Albright, Dale Schlenker, Tammy Wilkinson, Sgt. Painter and Chuck Figard present.

The following items were discussed:

a. Request for a handicapped sign at 162 N. 3rd Street was approved.

b. Request for a similar sign at 257 S. 4th Street was denied pending further information.

c. Request for a 4-way stop sign at 3rd and Island Street was not approved.

d. Request of a shelter for school children at 3rd and Island Streets was not approved.

e. Replacement for the traffic light pole at 4th and Pine will be handled by Telco. The pole was side-swiped by a tractor trailer operator who was apprehended and charged with several offenses.

f. The transfer switch on the power pole at S. 4th and Rt. 61 has been installed. In the event of a power loss at that site firemen will be able to plug in a generator to provide sufficient power to keep the traffic lights operating on a limited basis. Rt. 61 traffic will see flashing yellow lights, S. 4th St. will see blinking red lights.

g. The police department has received a bill for $1,887.12 for Classic Harley-Davidson for repairs & parts necessary to convert the borough’s motorcycle to civilian style and re-sale. The borough will claim the replaced parts and offer them for re-sale to reduce the overall cost.

Being investigated

Truck routes in and through the borough when Penn Dot begins ramp construction.

PERSONNEL COMMITTEE

 

January 21, 2004

Business discussed:

1. Lynda read a list of park and pool employees to be hired for the

summer.

2. A first draft for guidelines for a junior councilperson was looked at for contemplation and revision. The Borough News website is going to be researched for other suggestions.

3. Officer Schwoyer distributed guidelines for crossing guards. Discussion and suggestions were scrutinized at length. Final form to be presented as soon as possible.

4. Executive session for the purpose of specific personnel matters was held.

OLD BUSINESS

On the recommendation of the Borough Manager, a motion was made by Charles Figard and seconded by Martha Bertolet to approve releasing $46,975.19 from the Line of Credit to reimburse general account for expenses incurred under the Capital Improvements Project.

On the recommendation of the Personnel Committee, a motion was made by Jeanette Heckman and seconded by Tammy Wilkinson to approve the Crossing Guard Policy as presented and corrected.

(Councilwoman Heckman stated that there will be an addition made on the policy stating that personnel files will be maintained and the name change for Painter being Acting Chief of Police. Ms. Heckman also stated that there was no way to assure anyone’s work before it is performed. It must be evaluated as it happens. Officer Schwoyer met with the crossing guards and explained the policy and went over the personnel files being kept. Mayor Del Rosario also went over the policy with them at the crossing guard breakfast. Councilwoman Heckman stated that a line will be placed on the policy stating that personnel files will be kept on each crossing guards.)

SOLICITOR’S REPORT

An executive session was called at 7:40 p.m. to discuss hiring of police personnel.

Meeting reconvened at 8:25 p.m.

A motion was made by Jeanette Heckman and seconded by Tammy Wilkinson to give full-time status to Officer Bill McEllroy and Officer Chris Hartz who have completed their one-year of probation effective February 4, 2004.
