MINUTES FROM THE MAY 10, 2004 MEETING OF BOROUGH COUNCIL

The ninth regular meeting of the Hamburg Borough Council for 2004 was held this evening at the Hamburg Municipal Center with President Adam Dries presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

Members Present – Adam Dries, Tammy Wilkinson, Charles Figard, Jeanette Heckman, Martha Bertolet

Members Absent – Tina Yoder, Dale Schlenker

Also Present – Kim Y. Berger, Recording Secretary, Lynda Albright, Borough Manager, Solicitor Shollenberger

A motion was made by Charles Figard and seconded by Martha Bertolet to approve the amended agenda.

Richard Boyd questioned whether the two officers that were going to be hired as part time officers met the criteria of civil service. President Dries stated that the Civil Service requirements are for full-time officers only. Mr. Boyd stated that there are seven officers that have passed all the testing requirements for civil service. Mr. Boyd stated that the idea was to improve the quality of the police officers in the department and that they be given the opportunity and not use officers who have not passed the civil service test and use a lower grade officer.

Chief Painter stated that Civil Service does not part time officers. The two officers that we are looking to hire are actually "re-hires". They have worked for the borough before, they know the procedures, we have their uniforms, etc. They do not have to go through the FTO program, only a refresher course on the computer and the new policies placed in effect. These officers have no "bad reports" in their files.

Mr. Boyd stated that there are many officers who worked for Hamburg Police Department who may have wanted to work for the police department but this position was not advertised.

Councilman Figard questioned if the two individuals know that this is only part-time and not a full-time position. Chief Painter stated that they know that if they want to become a full-time officer that they would have to go through Civil Service.

Lori Guldin questioned why Civil Service testing is done. Mr. Boyd stated that Civil Service is designed to take the politics out of the hiring. Civil Service comes into play when the department reaches a certain number of full-time officers. Civil Service is to make sure that we get the most qualified person for the job.

A motion was made by Jeanette Heckman and seconded by Tammy Wilkinson to approve the minutes of the April 26, 2004 meeting.

BOROUGH MANAGERS REPORT
APRIL, 2004

The Borough Manager’s activities for the month of April, 2004 included the following:

Held Staff meetings to discuss various issues.

Met with Ken Fogel to review the bridge inspection reports for the bridges that the Borough are responsible for. Some repair work is anticipated, but nothing of any major concern.

Met onsite at the borough lot across from NAPA to ascertain property boundries. Met with Barry Weaver, Surveyor, Council members Dale Schlenker and Tammy Wilkinson, John Leonforte, Ken Chubb, owner of NAPA and Richard Pickel, public works supt.

Council member Tammy Wilkinson and I worked on finalizing the filing of several grants through DCED. Grant applications were for the baby pool, borough truck, equipment for police department.

John Leonforte and I attended the Our Town foundation Board meeting for updates on outstanding issues relative to the Barta Bus and the traffic study to be done later this year.

Met with representative from Bartus signs to finalize the purchase of a new baseball scoreboard at the park. The majority of the money for this purchase is being donated. It is anticipated that the sign will be ready for installation the early part of June.

Met with Eric George, who is now working for the Fleetwood Bank, to advise me of the services he has to offer to the Borough and to advise that he would soon have an office located in the Borough.

Met with Bob Reed of RPA to look at the installation of the HVAC system I the senior center to try and determine what is causing an odor problem in the borough offices. If it is determined that the duct work was not installed properly, the architect will contact the contractor and advise him to make the necessary corrections to the system.

Had a meeting with EPA to discuss various issues regarding the lead removal in the Borough.

Met with Finance Committee Chairwoman Martha Bertolet to review the quarterly financial receipt and expense statements in order to provide a better understanding of how the Borough finances are handled.

Met with John Leonforte, Code Enforcement/Building Inspector several times during the month to be updated on on-going projects he is working on, as well as the proposed zoning ordinance and the new Statewide Building Code.

Handled complaints as needed.

In addition to the two regular council meetings, Authority Meeting, Recreation Board, and Planning Commission, attended Property committee, Safety Committee, Road Committee, W/S/Public Relations.

PUBLIC WORKS SUPERINTENDENT’S REPORT
APRIL 2004

The crew placed ¼" stone on the Greenway trail.

The wind has played havoc with our signs again. We spent time repairing a lot of the signs.

Cold patching continues around the borough.

Grass mowing has started. This will keep us very busy trying to catch up with all the rain that we have had. Mowing commenced at the parks, municipal building and library and along Port Clinton Avenue and Chestnut Street.

The process of getting the swimming pool ready has begun. The baby pool has been repaired and seems to be holding water.

The crew has started to mulch around the playground equipment.

The crew flushed fire hydrants.

Repaired ½" service line in Plum Alley.

The street sweeper program has begun for the year.

Removed all the spreaders and plows from the winter.

The crew installed a light in the storage room of the municipal building.

During the month I attended staff meetings as required.

Water/Wastewater Superintendent’s Report April 2004

Water

Most production for the month was from the surface source.

We spent considerable time working on monitoring and recording issues. Both Roberts Filter and Clark Electric were on site to help trouble shoot the problems. We have made considerable progress and can, at least, get the monitors and meters to agree. Roberts continues to assist in trouble shooting other issues.

Hydrants were flushed and the system seems to be in good condition.

Wastewater

In home I & I inspections are continuing. Most residents have been very cooperative and we are making progress. The inspections in the first zone are almost complete and repairs are, for the most part being made in a timely manner. Recent heavy rains would indicate that these repairs are having some effect. Flows increase rapidly and fall quickly as well indicating inflow and less infiltration. The next round of inspections will start in June.

We are applying for a permit modification to increase the size of one pump at the Ridge Lawn Pumping Station. Flow in that area continues to increase beyond what would be expected for the size of the system.

We are still struggling on the operational side. Incomplete nitrification is making disinfection difficult. Additionally, sludge production is up and we are running the belt filter press every day increasing loading on the primary clarifiers and anaerobic digesters.

OFFICE MANAGER’S REPORT
APRIL 2004

Throughout the month of April spent at great deal of time setting up appointments for inspections of homes for the infiltration study. Also have called those individuals who have not responded. Mailed letters to those property owners who had issues that had to be corrected.

Spent time working on Civil Service issues. Preparing for the physical agility portion of the testing.

Season ticket applications were mailed to those individuals who had season tickets last year. We have begun receiving applications and payments.

Worked with the water/sewer superintendent on specifications for a van for his department.

Met with the Recreation Director to update various paperwork for Community Days.

Prepared the recycling grant.

Attended County EMA training at the Fire Training Facility.

Updated the web page and municipal access channel.

Various letters regarding junk cars, weeds and meters being blocked were mailed.

Orientation memos, employee contracts for park and pool employees were typed and mailed.

Attended two council meetings, one EMA meeting and staff meetings as necessary.

CHAPLAIN’s REPORT

PROPERTY MEETING - APRIL 27, 2004

MUNICIPAL BUILDING – 4 PM

ATTENDING: Lynda Albright, Chuck Figard, John Leonforte & Dale Schlenker

VISITOR: Richard Boyd

A letter of notification was forwarded to Lady T giving 15 days to remove all items from the Borough Canal Property. The Borough was asked for an additional 15 days to remove such items and the request was honored. All items must be removed by May 21, 2004.

All work to the DJ’s office and storage area has been completed.

The property committee recommends Borough Council move forward with the updated Zoning Ordinance; advertise a public meeting and invite all to participate in dialog concerning this ordinance.

Mike Kershner has completed the task of marking all the electrical boxes.

The Borough Solicitor will handle the particulars concerning the land swap, with Dave Stewart.

The former Wright’s building will not become part of the KOZ application due to lack of owner cooperation.

The challenges of having Barta service downtown Hamburg are about over. Traffic light sensors will be relocated within the month, the Borough crew will mark the streets, new signs will be installed and we should be ready to go by June 1, 2004. Hooray!!

The Borough Garage building is in need of repair. The poles are beginning to rot and it was recommended the poles be exposed and an epoxy product applied to encase the poles which will end the rot problem. It was also noted more room is need for salt due to the fact cinders are so scarce. This will be addressed further with recommendations forwarded to council in the near future.

Scoreboard at park has been ordered from Bartush Signs, Orwigsburg, Pa. and should be here by the end of May, 2004.

The property committee recommends council publish the new Curb & Sidewalk Ordinance immediately.

Property committee recommends the immediate repair of the railing leading to the second floor. The railing is very loose and could be a hazard to the public. A proposal was received from ML Construction to completely repair the railing for $2896.00.

The property committee recommends the purchase of two (2) overhead doors for the pool bath housed so as to be able to secure them properly. The cost is $1200.00.

Lynda & John Leonforte were instructed to contact Jim Lillis of Kozloft-Stoudt concerning the Inter-Municipal agreement proposed for the Uniform Commercial Code and it application to Hamburg.

The project at Cougles is proceeding and will be completed after PennDot completes their project.

The Property Maintenance Code and it’s fee structure will be addressed after the UCC is adopted.

PERSONNEL COMMITTEE REPORT
5/4/2004 – 4:00 P.M.

PRESENT: DALE SCHLENKER, TINA YODER, LYNDA ALBRIGHT, CHIEF PAINTER

ABSENT: Jeanette Heckman, Chuck Figard

Robert Grugan has successfully completed probation and recommendation from the Borough Manager/Personnel to appoint Mr. Grugan as a regular full-time employee retroactive to May 6, 2004 and increase his salary to $12.50/hr.

Lynda presented an application for a Recreation Board candidate. She was instructed to set up an interview with the committee within the month.

The Police Chief’s employment agreement was discussed and it was decided to provide copies to all members of council and the mayor before action is taken. Lynda and Solicitor Speicher have made some changes as necessary to cover Mike’s probationary period.

Personnel Committee is recommending the addition of one paragraph of the Public Participation Notice, which was inadvertently left out when initially approved.

Discussed the hiring of two part-time officers and Personnel is recommending the hiring of Doug Williams effective immediately and the hiring of Bill Kramer

to be effective upon the completion of his Act 120 Certification on June 3, 2004.

On the recommendation of the Property Committee, a motion was made by Charles Figard and seconded by Tammy Wilkinson authorizing the Borough Manager to purchase two rolling doors for the for the pool bathrooms from Overhead Door Company at a total cost of $1,280.00.

On the recommendation of the Property Committee, a motion was made by Jeanette Heckman seconded by Martha Bertolet authorizing ML Construction to reinforce the front stair railing as per the quote at a cost not to exceed $2,896.00.

On the recommendation of the Borough Manager and Personnel Committee, a motion was made by Jeanette Heckman and seconded by Charles Figard to have Robert Grugan become a permanent full-time employee, having successfully completed his six-month probation and that his salary be increased to $12.50/hr. retroactive to May 6, 2004.

In addition, to approve the change in the first paragraph referring to meeting times, changing the fourth Wednesday to the fourth Monday.

(Discussion: Mr. Boyd questioned if there would be additional time above the 20 hours for court time. Chief Painter stated that the 20 hours is shift work only.)

SOLICITOR’S REPORT

Solicitor Shollenberger stated that in two weeks Solicitor Speicher will discuss with council his thoughts about a meeting that was held with representatives from EPA regarding lead contamination in the borough. Notes are forthcoming to council members, please read them so it can be discussed at the next meeting.

Executive session was called at 7:55 p.m. to discuss the police contract and the Chief’s contract.

A motion was made by Jeanette Heckman and seconded by Tammy Wilkinson to remove from the table the motion regarding the part-time officers.
