MINUTES FROM THE SEPTEMBER 26, 2001 COUNCIL MEETING

The eighteenth regular meeting of the Hamburg Borough Council for 2001 was held this evening at the Hamburg Municipal Center with President Richard Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

Members Absent – None

A motion was made by Roy Heffner and seconded by Scott Kreider to approve the amended agenda adding under New Business a request from the School regarding bonfire and "parade".

A motion was made by Roy Heffner and seconded by Charles Figard to approve the minutes of the September 10, 2001 meeting.

ENGINEER'S REPORT
SEPTEMBER 19, 2001

SANITARY SEWER SYSTEM

· SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal to low for this time of year. Treatment is within normal parameters. Settleability problems are again causing problems, but plant personnel are handling it on a daily basis.

· MID-ATLANTIC CANNERS

No issues

· LOCAL LIMITS CALCULATIONS - (NO CHANGE)

The EPA has accepted the local limits as submitted by SDE. Lynda is working on obtaining proof of adoption of the new limits from all required boroughs and townships.

EDENBURG P.S.

Systems Design Engineering, Inc. and plant personnel performed pump down tests to check the force main. It appears the pumps are performing at about 85% of rated capacity. Systems Design Engineering, Inc. met with the pump station manufacturer to determine how to increase flows out of the station.

WATER SYSTEM

WATER PRODUCTION

The impoundment dam is down about 10 feet. Water production has been off of wells for most of this month, with no problem to report.

HAMBURG CENTER

Systems Design Engineering, Inc. will update the board on the issues to date.

FILTRATION PLANT LIGHTS

The lighting project has been completed.

Personnel Committee

September 11, 2001 – 6 pm

Present: J. Heckman, C. Figard, R. Boyd, D. Edwards, L. Albright

Business conducted: Will advertise for a recreation director and secretary for the police department. Will ask Beryl Ayello to work in the police department on a "temporary basis" until someone is hired as secretary in that position. Council will send a thank you letter to Tonya Gerner for a job well done for Community Days.

Safety Committee

Committee met at 7:10 P.M. Tues 18 Sept. with the following persons present: Lynda Albright, Leon Balthaser Balthaser, Rick Boyd, Roy DelRosario, Diana Edwards and Chuck Figard.

The following items were discussed:

Details of the apprehension of an alleged housebreaker by a Borough police officer.

Marking of the former unmarked police cruiser by Chief Zelinsky and the Mayor. The "new" cruiser was washed and cleaned inside and out, then waxed.

Results of a 5-day monitoring by the Borough show that only six or seven tractors use Apple Alley during normal business hours.

Request for a handicapped parking space for Lauri Fritz at 53 N. 2nd St was denied. The medical condition was not considered serious enough to warrant the request.

Nester Sanitation requested removal of a parking space at N. 3rd St. and Plum Alley due to turning space. Limitations for their large trucks. Further investigation is required prior to action on the complaint.

A building owner requested Borough assistance to prevent skateboarders, bike riders, etc from using sidewalks. Further contact by Borough officials with the owner will be made.

Request made by committee to Chief Zelinsky to standardize method of removing unlicensed/uninspected/junked vehicles from private property.

Penn Steel representatives have been advised to clean up their property on the east side of Apple Alley between Maple and Arch Streets.

Further efforts needed to reduce domestic problems at a N. 4th St. residence. Details will be discussed at a later meeting.

Diana Edwards asked Borough police assistance to reduce confusion at 7th and Windsor streets during the period from approximately 7:20 – 7:50 A.M. when students are arriving at the school parking lot off Windsor St.

Request was made by Rick Boyd to have Borough ordinances checked to determine how many animals and the types that can be maintained in the borough. Chief Zelinsky will investigate.

Chief recommended a Borough ordinance controlling concerts in the Borough as to time limits, methods of payment for extra police protection etc.

No action taken at this time.

OLD BUSINESS

A motion was made by Roy Heffner and seconded by Charles Figard to adopt Ordinance #701-01, reducing the speed limit on State Street between the Schuylkill Bridge and 2nd Street from 35 mph to 25 mph.

NEW BUSINESS

Mayor made the following proclamation for parking prohibitions for King Frost 2001.

Under Section 3, Chapter XV as amended by ordinance number 430, dated July 10, 1973, the following parking restrictions will be in effect from 4:00 P.M. on Saturday October 27, 2001 to 12:00 P.M. on Sunday, October
28, 2001.

NO PARKING

1. On North 5th St. between Franklin and State Sts.

2. On North 5th St. between Franklin St. and Confer Ave.

3. On Franklin St. between Church and North 4th Sts.

4. On Northmont Ave. between Port Clinton Ave. and North 4th St.

S. On Maple St. between South 3rd St. and South 5th St.

6. On 3rd St. between Maple St. and Port Clinton Ave.

7. On 4th St. between Maple St. and Confer Ave.

8. On Port Clinton Ave. between North 4th St. and Mountain Ave.

9. On both sides of William St.

10.On Confer Ave. between North 4th St. and North 5th St.

On the recommendation of the Property Committee, a motion was made by Jeanette Heckman and seconded by Diana Edwards to permit Synergetics Architects to put out for bid the restoration of the cupola of the Hamburg Public Library.

(Question: How much is this project? Manager Albright stated that the estimates are around $12,000.)

On the recommendation of the Negotiating Committee, a motion was made by Roy Heffner and seconded by Jeanette Heckman to approve the proposed Police Contract for years 2002, 2003 and 2004.

(Comment: Councilman Balthaser stated that negotiations went quickly all of a sudden. Councilwoman Heckman stated that the Negotiating Committee and Police Association have actually been working on this for quite a few months).

Manager Albright stated that she received a request for permission to hold the annual bon fire at the High School on Friday, September 28, 2001 as well as a request to have a "parade" through town this same evening. The "parade" would consist of the fire truck and several decorated cars for homecoming.

A motion was made by Jeanette Heckman and seconded by Scott Kreider to permit the Hamburg Area High School to hold the annual bon fire and permit the procession throughout town.

A motion was made by Roy Heffner and seconded by Charles Figard to approve payment of invoices totaling $45,894.64.

(Question: Councilman Kreider questioned the invoice from Galls regarding a remote siren and mounting adapters. It was stated that these items were for the police motorcycle. Councilman Kreider stated that he thought the motorcycle came fully equipped. Chief Zelinsky stated that the siren they were going to use did not work and the adapters were the wrong ones that is why they had to purchase a new siren and adapters.)

SOLICITOR’S REPORT

Solicitor Speicher stated in regards to the ordinance dealing with widening Confer Avenue between 4th Street and Northmont Avenue, the right of way was thought to be 5 feet when in actuality the right of way is 17.15 feet. The Borough needs to make this correction and the ordinance does not have to be redone.

An executive session was held from 7:42 p.m. to 7:57 p.m.

In regards to the lawsuit pertaining to the PA Public Retirement Commission, a motion was made by Scott Kreider and seconded by Charles Figard to authorize Lynda Albright to execute the verification to the answer to that petition.

A motion was made by Charles Figard and seconded by Diana Edwards to request the Police intervene on behalf of the borough in the cause of action and to authorize the preparation of the intervention papers.

There being no further business, the meeting adjourned at 8:03 p.m. on motion of Diana Edwards and seconded by Charles Figard.
