GENERAL DEPARTMENT INFORMATION

In 1997 the Code Enforcement Office was created to administer and enforce the codes. The Department is staffed by one part-time code official with the assistance of two third party inspection agencies. Currently, the Borough administers and enforces the 2009 International Codes in accordance with the PA Uniform Construction Code which went into effect 11/12/2001. The third party inspection agencies used by the Borough are: American Inspection Agency, Inc. and System Designs Engineering, Inc.

The mission of the Department is to provide a safe environment for our citizens who reside, work and recreate in Hamburg Borough. The department is committed to help you with any questions concerning the permit process.

The time to call the Department of Code Compliance is before you start a project to avoid problems and delays. By submitting the proper information, the permit can be issued in a timely manner. Tell us what you plan to do, and we will explain the code requirements and assist you until the project is completed in accordance with the codes. A building permit is a license to begin construction of a building project or to install equipment regulated by the code. Permits and inspections are necessary to verify that the Borough building and fire codes standards are met. If not, the public’s health, safety and welfare could be at risk. The Borough administers and enforces the 2009 International Residential Code in conjunction with the Pennsylvania Uniform Construction Code as its standard for residential construction and equipment installations.

If you hire a professional contractor to do the work, select a qualified builder who is familiar with the Borough building codes and procedures. This could save you time, money and eliminate potential problems. The codes apply whether a professional or a do-it-yourselfer does the job.

Most people realize that new buildings, additions, remodeling, decks, outbuildings such as sheds and garages, and swimming pools, and demolition of existing structures usually require building permits and inspections. Less obvious projects that require permits include fire alarm and security systems, spas or hot tubs, water heaters, wood or gas stoves, masonry or factory built chimneys, and work involving electrical, plumbing, heating and air conditioning systems.

After contacting the Department, you must complete an application and submit the permit fee, plans, and information in order to obtain a building permit. Code officials can also provide information that will help your project be a success and avoid potential problems, which could cost you time and money.

The permit application will require basic information about the project, such as who will perform the work, what work will be done and how the work will be done. The application also will ask you to submit sketches, plans or other documentation for review. If the construction plans do not comply with the Building Code, Zoning and other related Ordinances, you will need to adjust your plan to meet the requirements for a permit.

To receive a permit you will have to pay a permit fee. The fee helps defray the cost of the Borough’s resources spent on the application, review and inspection process. The fee also gives you access to the Department’s knowledge and experience when you have questions about the construction project. Additional fees are required for inspections.

Post the building permit at the construction site so it is visible from the street. Work must be performed in accordance with approved plans and the 2009 International Residential Code. Any proposed changes to the original approved plans need to be brought to the attention of the code official. Some changes will require review and approval of revised plans.

Once the work begins, the Code Compliance department will inspect each phase of construction; that is, footing, foundation, framing and final inspection. It is the responsibility of the permit applicant to schedule inspections. Normally, you want to give the Department at least two days notice for inspection. If the code official finds that some work does not meet code, our inspector will tell you so and what needs to be done to bring the work up to acceptable compliance standards.

When the work is done and the code official approves the final project, you will receive a Certificate of Use and Occupancy. This Certificate formally marks completion of the project with the knowledge that it meets Building Code and Zoning Requirement standards. Lastly, please know that any open burning of refuse, leaves, or trimmings are prohibited by the Borough Fire Code Ordinance.

 

Pennsylvania Uniform Construction Code Becomes a Reality

On 6/28/2004, the Hamburg Borough Council officially adopted the new statewide building code, officially known as the Uniform Construction Code (UCC). This Code will be administered and enforced in every municipality throughout the Commonwealth.

The UCC sets minimum standards for design and construction; the 2009 International Residential Code is the new standard for residential construction while the 2009 International Building Code is the new standards for non-residential construction.

The following list highlights several code changes for residential construction:

There is a new minimum energy conservation standard for new construction, additions and the portion of the building undergoing alterations.
If finishing basement, an emergency egress/rescue opening is required, which opens directly to the outside of the home.
Wall bracing requirements are more restrictive.
Arc-fault circuit protection is needed on all new bedroom electrical circuits.
Smoke detectors need to be 110-volt interconnected with 9-volt battery backup when feasible for all projects requiring a building permit. Minimum ceiling height in habitable spaces is 7 feet.
One-family dwelling-Accessory structures such as detached carports, garages, greenhouses and shed less than 400 square feet no longer require building permits. However, a zoning permit is required.

When Is A Residential Building Permit Required?

Building permits are required for new homes, additions, alterations, basement remodeling sunrooms, swimming pools, spas/hot tubs, decks and accessory buildings larger than 400 square feet. (Always check with the Zoning Department before starting any project which does not require a building permit because a zoning permit may be required.)

It’s never too early to start the planning process for new building projects. Maybe this will be the year for the new deck, swimming pool, hot tub, spa, basement alteration or sunroom additions! Thoughts of warm weather, coupled with tax refund, contribute to a tidal wave of home improvement permit applications and plans submitted to the Code Compliance Department each year.

Proper planning and complete permit applications with accurate plans can help eliminate unnecessary delays and costs and we may be able to issue your building permit within a two-week time frame. Permit applications are processed and reviewed in the order they are received. Don’t forget the permit process includes compliance with both Borough Zoning Ordinance and the 2009 International Residential Code as part of the Pennsylvania Uniform Construction Code. Selecting a qualified contractor is also an important consideration. It is suggested that you ask the contractor for a list of projects performed in the Borough which were successfully completed in accordance with Borough standards. Also, it is suggested your construction contract include a provision stating the final payment will be withheld until all work is completed and inspected and approved by a Borough Code Official. The Borough will perform various inspections during construction, as noted on the permit, to verify compliance with the Borough approved plans and building codes.

Thinking of Selling Property?

Property Transfer Inspection -- Certificate of Compliance

When placing your home on the market for sale one of the first things you should consider is whether your home has a valid Certificate of Compliance. The settlement or lending company may require a copy of the Certificate of Compliance at closing.

Since 2008, the Borough Zoning Ordinance requires that all residential, commercial and industrial structures, both new and existing, have a Certificate of Compliance, a document issued by the Borough that indicates the building or structure satisfies the provisions of the Property Transfer Ordinance and other applicable requirements. Existing structures, upon transfer, must comply with the borough Ord.757-08, which covers the following life safety requirements:

All residential dwellings are required to display street numbers (numerals only) that are at least 2 Ύ inches in height and in a position easily readable in both directions from the adjacent roadway. All numbers shall be of contrasting colors to their background on which they are placed, installed in a permanent nature, and be a least 18 inches above adjacent grade.
Main exit door at the front of the dwelling shall be readily opened able from the inside without the use of key or any special knowledge or effort. Double cylinder-keyed dead bolts on the main exit door are prohibited.
UL listed battery powered smoke alarms shall be installed on each level of the home including the basement, outside of each sleeping room area in the immediate vicinity of sleeping rooms, and in each sleeping room. Each smoke alarm shall be installed on the ceiling or wall in accordance with the manufacturer’s installation instructions. The Code Official shall approve all alarm locations. Existing 110-volt powered, interconnected smoke alarm systems or monitored fire alarm systems that transmit a fire signal to a central station are subject to inspection and approval.
    1. Each dwelling unit must have a smoke detector installed on each floor level and in the bedroom area(s).
    2. Each room used for sleeping purposes must have a smoke detector installed.
    3. Each premises must have a carbon monoxide detector installed, provided that combustible fuel is used or if vehicles are garaged at the dwelling unit.
    4. An existing acceptable and safe sixty-ampere service, or minimum one-hundred-ampere three wire electric service, must be installed for the dwelling.
    5. An appropriated number of current occupants and the number of intended occupants at the premises, as more fully set forth in the International Property Maintenance Code, Ordinance No. 713-02, as amended [Part 4 of this chapter], the International Residential Code, Ordinance No. 713-02, as amended [Part 5 of this chapter], and the Uniform Construction Code, Ordinance No. 722-04, as amended [Part 6 of this chapter].
    6. All sidewalks and curbs must be in good repair, free of large cracks (covering more than 50% of the surface area and greater than a one-fourth-inch width) and crevices, missing bricks and tripping hazards (greater than ½ inch), and in compliance with Borough’s side-walk design standards.
    7. All premises must be supplied with clearly identifiable numbers (minimum of four inches tall) outside the premises, in clear view of the street, designating the street number of the premises.
    8. The premises must be in compliance with all other aspects of the International Property Maintenance Code, Ordinance No. 713-02, as amended [Part 4 of this chapter], the International Residential Code, Ordinance No. 713-02, as amended [Part 5 of this chapter], and the Uniform Construction Code, Ordinance No. 722-04, as amended [Part 6 of this chapter].
    9. No illegal sewer connections, as defined under the applicable Borough’s current sewer inspection policies.

If there is not a current Certificate on file for your home, an Application for Certificate of Use and Occupancy –Existing Structure can be obtained at the Municipal Office. The owner or authorized agent will need to complete the application, pay $65.00 for each single-family dwelling, and schedule an inspection with the Borough, allowing seven to ten days before the inspection. A preliminary inspection will be scheduled and requirements will be explained at that time. Certificates are issued if no violations are found during the inspection. If violations are found, a re-inspection must be scheduled to verify correction of the violations(s) prior to issuance of the Certificate. Certificates are also required for existing non-residential buildings.

Introduction________________________________________________________

This booklet was prepared to help you submit the information necessary for the Borough Staff to process your Application for Zoning Review, Building Plan Examination and Building Permit. The zoning and building code reviews are separate processes. Your project will be evaluated in terms of compliance with the Zoning, Building, Plumbing, Mechanical, Electrical and Fire Code Ordinances as adopted by the Borough of Hamburg. The information presented in this booklet is not all inclusive of code requirements. They are intended only to highlight areas which often present difficulties for designers, contractors, and Borough residents.

Upon issuance of the Building Permit, the Permit is required to be posted and visible from the Public Street. The permit approval requires compliance with all codes and ordinances which Borough of Hamburg has adopted.

One set of approved plans, specifications and permit amendments will be returned with Permit. The approved set must remain on the job-site until the final inspection and a Certificate of Use and Occupancy has been issued.

The permit applicant is responsible for making arrangements for inspections and insuring that the required inspections have been performed by the Borough Code Official. Changes need to be submitted to the Borough for review and approval. The required inspections are indicated on the back of the Permit card. When calling for required inspections, please provide the following information: Contractor Name, Project Location, Building Permit Number and Type of Inspection.

Structures may not be used or occupied until a Certificate of Use and Occupancy has been issued by the Borough.

Information Required if Applicable______________________________________

Location of an on lot sewage system
Location of the 100 foot clear sight triangle for all corner lots. Any lot which contains a 100 foot clear sight triangle MUST have the following note written on the site plan " Nothing shall be placed, planted, set, or put within the area of the 100 foot clear sight triangle that obscures motorist vision"
Location of the 100 year floodplain and the 100 year floodplain elevation. Any lot which contains a 100 year floodplain MUST contain the following note " Any proposed improvements to be located within the 100 year floodplain shall be in accordance with the Floodplain Management Provisions found in the Borough of Hamburg Subdivision and Land Development Ordinance"
The lowest floor, including the basement, of any new or substantially improved residential structure shall be elevated to a minimum of one (1) foot above the 100 year floodplain elevation
